ACS GROUP SERVICES PTY LTD - TERMS & CONDITIONS OF SERVICE


 

1.⁠ ⁠ACCEPTANCE OF TERMS

By accepting a quotation, engaging ACS Group Services Pty Ltd (“ACS”), providing site access, issuing a purchase order, approving works via email, text message or verbal instruction, or allowing services to commence, the Client acknowledges and agrees to be bound by these Terms and Conditions.
 

These Terms apply to all residential, commercial, strata, builders clean, maintenance, renovation, and specialty cleaning services provided by ACS.
 

2.⁠ ⁠QUOTATIONS

All quotations are based on information supplied by the Client and visual inspections where applicable.
 

Quotations remain valid for 30 days unless otherwise stated.
 

Should site conditions differ from those originally described, ACS reserves the right to revise pricing or issue a variation before or during works.
 

Additional labour, equipment, materials or services not included in the original quotation will be charged separately.
 

 3.⁠ ⁠ACCESS REQUIREMENTS

The Client must ensure safe and unrestricted access to the property at the scheduled service time.
 

Where ACS attends a site and is unable to gain access due to locked premises, unavailable keys, incorrect alarm codes, restricted access, unavailable site contacts or other circumstances beyond our control, the scheduled service will be deemed chargeable in full.
 

Any return visit required due to access issues will incur additional charges.
 

 4.⁠ ⁠SAFE WORKING ENVIRONMENT

ACS reserves the right to refuse, suspend or cease works where staff encounter:

•⁠  ⁠Unsafe conditions
•⁠  ⁠Hazardous materials
•⁠  ⁠Aggressive behaviour
•⁠  ⁠Dangerous animals
•⁠  ⁠Electrical hazards
•⁠  ⁠Structural hazards
•⁠  ⁠Excessive biohazards
•⁠  ⁠Working-at-height risks
 

The Client remains liable for all costs incurred up to the time works are suspended or terminated.
 

 5.⁠ ⁠GENERAL CLEANING EXCLUSIONS

Unless specifically included in writing, ACS does not provide:

•⁠  ⁠Removal of trade waste
•⁠  ⁠Removal of hazardous materials
•⁠  ⁠Hoarding remediation
•⁠  ⁠Biological waste removal
•⁠  ⁠Pest control
•⁠  ⁠Mould remediation
•⁠  ⁠Paint correction
•⁠  ⁠Repair works
•⁠  ⁠Restoration works
•⁠  ⁠Removal of construction materials
 

Additional services may be quoted separately.
 

 6.⁠ ⁠PROPERTY CONDITION

ACS provides cleaning services only.
 

We cannot guarantee removal of permanent staining, etching, corrosion, oxidation, deterioration, wear and tear, water damage, mould staining, discolouration, grout deterioration, damaged paintwork or defective finishes.
 

Certain surfaces may require restoration, repair or replacement rather than cleaning.
 

 7.⁠ ⁠MOVING OF FURNITURE AND CONTENTS

For safety reasons ACS staff will not move excessively heavy, oversized or hazardous items.
 

Where clients request furniture or contents to be moved, ACS accepts no liability for damage to flooring, walls, furniture, fixtures or fittings arising from such movement.
 

Additional labour required for moving items may be charged separately.
 

 8.⁠ ⁠WATER, POWER & UTILITIES

The Client must provide operational electricity and running water.
 

Where services are impacted due to unavailable utilities, ACS reserves the right to charge additional labour costs or suspend services.
 

 9.⁠ ⁠POST-CONSTRUCTION & BUILDERS CLEANS

Builders cleans are performed on the understanding that all major construction works have been completed.
 

ACS is not responsible for defects, scratches, chips, dents, paint defects, workmanship issues, manufacturing defects, incomplete works or trade-related damage present before cleaning.
 

Dust may continue to settle after construction activities have ceased. ACS is not responsible for dust resettlement after completion of works.
 

Any return attendance due to ongoing trades, additional dust generation or further construction activities will be charged separately.
 

10.⁠ ⁠SURFACE PROTECTION REQUIREMENTS

The Client, builder or principal contractor is responsible for ensuring all completed surfaces remain protected until practical completion.
 

This includes but is not limited to:

•⁠  ⁠Flooring
•⁠  ⁠Joinery
•⁠  ⁠Cabinetry
•⁠  ⁠Stone benchtops
•⁠  ⁠Timber surfaces
•⁠  ⁠Glass
•⁠  ⁠Stainless steel
•⁠  ⁠Fixtures and fittings
 

Where protective coverings have been removed prior to completion of all trade works, ACS accepts no liability whatsoever for scratches, scuffs, marks, chips, stains, abrasions or other damage discovered before, during or after cleaning.


11.⁠ ⁠GLASS SCRATCH WAIVER

The Client acknowledges that post-construction glass may contain fabrication debris, weld spatter, metal particles, concrete residue, render contamination and other defects that may cause scratching during cleaning.

By accepting our quotation, the Client expressly accepts the ACS Glass Scratch Waiver.
 

ACS shall not be liable for scratches, marks, abrasions or damage to any glass, glazing, mirrors or glazed surfaces discovered before, during or after cleaning.
 

All glass cleaning is undertaken entirely at the Client’s risk.
 

12.⁠ ⁠PHOTOGRAPHIC RECORDS

ACS reserves the right to photograph site conditions before, during and after works for quality assurance, training, dispute resolution and liability management purposes.
 

13.⁠ ⁠VARIATIONS

Where additional work is required due to site conditions, contamination levels, incomplete construction, excessive dust, trade damage, inaccessible areas or any circumstance not reasonably identifiable during quoting, ACS may issue a variation.

Variations are payable in addition to the original quotation.
 

14.⁠ ⁠CANCELLATIONS – ONE-OFF SERVICES

For one-off services, including builders cleans, end-of-lease cleans and renovation cleans:

•⁠  ⁠More than 5 business days notice – No charge
•⁠  ⁠2 to 5 business days notice – 50% cancellation fee
•⁠  ⁠Less than 48 hours notice – 100% cancellation fee
 

15.⁠ ⁠COMMERCIAL SERVICE AGREEMENTS

For ongoing commercial clients, a minimum of 30 days written notice is required to:

•⁠  ⁠Cancel services
•⁠  ⁠Suspend services
•⁠  ⁠Reduce service frequency
•⁠  ⁠Terminate agreements
 

Services scheduled during the notice period remain fully payable.
 

16.⁠ ⁠CHANGES TO CLEANING DAYS

ACS allocates labour and resources in advance.
 

Requests to permanently change cleaning days, times or service schedules must be provided in writing with at least 14 days notice.
 

One-off schedule changes require a minimum of 5 business days notice.
 

Requests made with insufficient notice may be declined or charged as a missed service.
 

17.⁠ ⁠INVOICING & PAYMENT

Unless otherwise agreed in writing:

•⁠  ⁠Commercial invoices are issued monthly in advance.
•⁠  ⁠One-off invoices are due within 7 days.
•⁠  ⁠Recurring services are payable in accordance with the agreed service schedule.
 

Failure to pay an invoice does not entitle the Client to withhold future payments.
 

18.⁠ ⁠OVERDUE ACCOUNTS

ACS reserves the right to:

•⁠  ⁠Suspend services
•⁠  ⁠Charge interest on overdue accounts
•⁠  ⁠Recover collection costs
•⁠  ⁠Engage debt recovery agencies
•⁠  ⁠Recover legal costs on a full indemnity basis

All recovery costs incurred remain payable by the Client.
 

19.⁠ ⁠PRICE REVIEWS

ACS reserves the right to review pricing annually or where significant increases occur in:

•⁠  ⁠Award wages
•⁠  ⁠Superannuation
•⁠  ⁠Fuel costs
•⁠  ⁠Insurance premiums
•⁠  ⁠Consumables
•⁠  ⁠Regulatory costs
 

A minimum of 30 days written notice will be provided.
 

20.⁠ ⁠NO SOLICITATION OF STAFF

The Client agrees not to directly employ, engage, contract or solicit any ACS employee, subcontractor or contractor for a period of 12 months following completion or termination of services.
 

Where such engagement occurs, the Client agrees to pay ACS a recruitment fee equal to 50% of the contractor’s annual service value.
 

21.⁠ ⁠DEFECT NOTIFICATION

Any concerns regarding completed works must be reported within:

•⁠  ⁠24 hours for commercial cleaning
•⁠  ⁠48 hours for builders cleans
•⁠  ⁠72 hours for residential cleaning
 

Photographic evidence may be requested.
 

ACS must be given reasonable opportunity to inspect and rectify any verified issues before third parties are engaged.
 

22.⁠ ⁠REFUNDS

ACS does not provide refunds for services rendered.
 

Where a legitimate service deficiency exists, ACS reserves the right to rectify the issue at its discretion.
 

23.⁠ ⁠LIMITATION OF LIABILITY

To the maximum extent permitted by law, ACS Group Services Pty Ltd’s liability is limited to the value of the service provided.
 

ACS shall not be liable for indirect, consequential, incidental or economic loss arising from the provision of services.
 

24.⁠ ⁠GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of New South Wales, Australia.
 

25.⁠ ⁠ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between ACS Group Services Pty Ltd and the Client and supersede all previous agreements, representations and understandings.
 

By accepting a quotation, issuing instructions, making payment, or allowing works to commence, the Client acknowledges and accepts these Terms and Conditions in full.
